Environmental Information Regulations 2004

Separate legislation, the Environmental Information Regulations 2004, covers requests for environmental information. More information and a definition of what constitutes environmental information can be found on the Defra website.

It includes:

the state of any water or air, the state of any flora or fauna, the state of any soil, or the state of any natural site or other land

  • waste, emissions and discharges into the environment
  • any activities or administrative or other measures (including any environmental management programmes) which are designed to protect these
  • the state of human health and safety, including the contamination of the food chain

Requests for information under the EIR should be made in the same way as for those under FOI
